The first piece of a criminal defense case is the arrest. An arrest is made after a Magistrate is convinced reasonable evidence exists to issue a warrant. The authorities must present evidence that a crime was committed and that the person named in the arrest warrant likely committed the crime. The evidence may take one of the following forms:
● Reasonable facts alleging the crime and the accused: a recitation of the factual basis forming the belief a crime was committed and the person named in the arrest warrant committed that crime must be set forth for Magistrate review
● The sworn testimony of the person making the request: a statement, sworn to by the officer or other legal authority seeking a warrant, may be presented for Judge consideration when an arrest warrant is sought
● Affidavit: similar to sworn testimony, this document sets forth the facts for review upon submission of a request for a warrant
● Other evidence: sworn to by others with knowledge of the facts set forth in a sworn statement
