A common charge many young adults face is minor in possession (MIP). This charge is one made when an underage person is caught in possession of alcohol. The law provides punishment based on the number of offenses. For example:

● First offense: payment of a fine of not more than $100.00. The Court may also order participation in substance abuse classes or rehab.

● Second offense: imprisonment for not more than 30 days if the Court finds a violation of probation or a failure to successfully complete any Court ordered treatment or community service. A fine of not more than $200.00 may also be imposed and participation in substance abuse and rehabilitation courses along with community service may be imposed for a second offense.

● Third offense: imprisonment for not more than 60 days if the Court finds a violation of probation or a failure to successfully complete any Court ordered treatment or community service. A fine of not more than $500.00 may also be imposed and participation in substance abuse and rehabilitation courses along with community service may be imposed for a third offense.

We seek imposition of the most lenient sentence and also work for a deferred sentence to be imposed.
